1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the VJs TV website at vjstv.com and all related pages, content, features, and services (collectively, the "Platform"), operated by VJs TV, part of the VJs Mag Network ("VJs TV", "we", "us", or "our").

By visiting, browsing, submitting content to, or otherwise using the Platform in any way, you confirm that you:

• are at least 16 years of age (or the age of digital consent in your jurisdiction, whichever is higher);
• have read, understood, and agree to be bound by these Terms;
• have read and accepted our Privacy Policy, which is incorporated into these Terms by reference;
• have the legal capacity to enter into a binding agreement.

If you are using the Platform on behalf of a company, organisation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" refers to both you and that entity.

We reserve the right to update or modify these Terms at any time. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes where possible.

2. About VJs TV and Our Services

2.1 What We Offer

VJs TV is a global broadcast network and editorial platform dedicated to VJ culture — the art of live visual performance, projection mapping, generative art, and audiovisual creation. The Platform provides:

• Artist discovery — profiles, portfolios, and documentation of VJ artists worldwide;
• Project showcase — documentation of audiovisual projects, installations, and live visual performances;
• Events calendar — listings for festivals, live sessions, and events relevant to the global VJ and AV community;
• Technology directory — information about tools and software used in VJ and live visual performance;
• Studio listings — profiles of studios and production companies working in the visual arts;
• Live broadcast programming — live and archived streaming of VJ sessions and performances;
• Editorial content — articles, guides, and resources related to VJ culture and audiovisual arts;
• Partnership and sponsorship opportunities — for technology partners, brands, and event organisers.

2.2 Part of the VJs Mag Network

VJs TV is published as part of the VJs Mag Network, which may include related properties such as VJs Mag (vjsmag.com). References to the VJs Mag Network in these Terms include VJs TV and any associated properties under common operation. Each property may have its own supplemental terms where relevant.

2.3 Service Availability

We strive to keep the Platform available at all times, but we do not guarantee uninterrupted or error-free access. The Platform may be temporarily unavailable due to maintenance, technical issues, or events beyond our reasonable control. We are not liable for any loss or inconvenience caused by downtime or unavailability.

2.4 No Account Required for Browsing

You do not need to create an account to browse the Platform. However, certain interactions — such as submitting an artist profile, project, or studio listing — require you to provide personal information and agree to additional submission-specific terms set out in Section 5.

3. Intellectual Property Rights

3.1 VJs TV Content

All content on the Platform that is created or curated by VJs TV — including but not limited to the website design, layout, graphics, logos, editorial text, brand names, structure, and underlying code — is the exclusive intellectual property of VJs TV or its licensors, and is protected by copyright, trademark, and other applicable intellectual property laws.

You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, or commercially exploit any VJs TV content without our prior written permission, except as expressly permitted by these Terms or applicable law.

3.2 Fair Use and Personal Reference

You may share links to Platform content on social media or other public channels, provided that you do not misrepresent the source, remove attribution, or present the content as your own. You may quote short excerpts of text for commentary or journalistic purposes, provided that you clearly attribute the content to VJs TV and include a link to the original page.

3.3 Third-Party Content

Some content on the Platform belongs to third parties — including artists, project creators, event organisers, technology developers, and partners — and is used with their consent or under applicable licensing arrangements. Such content remains the intellectual property of its respective owners. VJs TV does not claim ownership of third-party content displayed on the Platform.

3.4 Trademarks

"VJs TV", "VJs Mag", the VJs TV logo, and related marks are trademarks of the VJs Mag Network. You may not use our trademarks, logos, or brand names in any way that implies endorsement, affiliation, or partnership with VJs TV without our prior written consent.

3.5 Copyright Infringement

If you believe that content on the Platform infringes your copyright or other intellectual property rights, please contact us at legal@vjstv.com with full details of the alleged infringement, including:

• identification of the copyrighted work you believe has been infringed;
• a description of the content you believe infringes your rights and its URL on the Platform;
• your contact information;
• a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or law;
• a declaration that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act on their behalf.

We will investigate and respond to valid notices in a timely manner.

4. Acceptable Use Policy

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not use the Platform in any way that:

Violation of this Acceptable Use Policy may result in removal of your content, suspension of access to the Platform, and/or legal action where appropriate. We reserve the right to determine what constitutes a violation at our sole discretion.

5. Content Submissions

VJs TV invites artists, studios, project creators, and event organisers to submit content for potential publication on the Platform. This section governs all such submissions.

5.1 What You Can Submit

The Platform accepts submissions for:

• Artist and VJ profiles — including bio, visual work links, location, and technology used;
• Audiovisual and VJ project documentation;
• Studio and production company listings;
• Event and festival listings relevant to VJ and live visual culture;
• Partnership and sponsorship enquiries.

5.2 Licence You Grant Us

By submitting content to VJs TV, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable licence to use, reproduce, publish, display, distribute, promote, and create derivative works from your submission (including images, video links, text, and associated metadata) across the Platform and our marketing channels, for the purpose of operating and promoting VJs TV and the VJs Mag Network.

This licence does not transfer ownership of your content to us. You retain full ownership of the intellectual property in your submission. We may credit you by name or alias where your content is used.

5.3 Your Warranties

By submitting content, you represent and warrant that:

• you are the creator or authorised rights holder of the content submitted, or have obtained all necessary permissions and licences to submit it;
• the content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party;
• the content is accurate, truthful, and not misleading;
• the content does not violate any applicable law or these Terms;
• you have obtained consent from any identifiable individuals featured in your submission where required by law.

5.4 Editorial Discretion

Submission does not guarantee publication. VJs TV retains full editorial discretion to accept, reject, edit, or remove any submission at any time, without explanation. We may also update the presentation of published content (such as formatting or categorisation) to maintain consistency with our editorial standards. We will not materially alter the substance of your submitted text without your consent.

5.5 Removal Requests

You may request the removal of your published profile, project, or listing at any time by contacting us at hello@vjstv.com. We will action reasonable removal requests within 14 business days. Note that some content may be retained in archived or cached forms beyond our control, or may be referenced in third-party content we have no ability to retract.

5.6 VJ Loop Packs and Digital Assets

Where VJ Loop Packs or other downloadable digital assets are made available through the Platform (whether free or paid), the following applies:

• Free assets — licensed for personal and live performance use only, unless the specific asset's accompanying licence states otherwise. Not for resale or redistribution.
• Paid assets — governed by the specific licence terms accompanying the purchase. All sales are final unless otherwise stated.
• You may not claim ownership of, resell, or sublicense any VJ Loop Pack or digital asset obtained through the Platform without the express written permission of the original creator.

6. Partnerships, Sponsorships, and Commercial Arrangements

6.1 Partnership Applications

Submission of a partnership or sponsorship application does not constitute a binding agreement. A commercial relationship between VJs TV and a partner or sponsor is only established upon execution of a separate written agreement signed by both parties.

6.2 Partner and Sponsor Content

Where partner or sponsor content is featured on the Platform, it will be clearly identified as such where required by applicable law or advertising standards. VJs TV does not endorse the products, services, or claims of sponsors or partners merely by publishing their content or listing them on the Platform.

6.3 Technology Partners

Technology tools and software listed in the Technology directory are provided for informational and community reference purposes. Listing does not constitute an official partnership, endorsement, or affiliate relationship unless explicitly stated in a separate written agreement.

6.4 Pricing and Payment

All partnership and sponsorship fees are agreed in writing in advance. Quoted prices are exclusive of applicable taxes (including VAT) unless stated otherwise. Payment terms are set out in the relevant commercial agreement. VJs TV reserves the right to adjust its pricing at any time; such changes will not affect existing agreements already signed and in force.

7. Newsletter and Communications

By subscribing to the VJs TV newsletter or any other communications from us, you consent to receive email updates about new artists, events, projects, live sessions, and Platform developments.

• You may unsubscribe at any time using the unsubscribe link included in every email we send, or by contacting hello@vjstv.com.
• After unsubscribing, you will no longer receive marketing emails, but we may still send you transactional communications (e.g. confirmations, legal notices) where necessary.
• We do not share your email address with third parties for their own marketing purposes.
• Our newsletter communications are governed by our Privacy Policy.

8. Third-Party Links and Embedded Content

The Platform contains links to external websites, embedded video content (such as Vimeo), social media profiles, and references to third-party tools, software, and services. These are provided for your convenience and information only.

• VJs TV has no control over, and accepts no responsibility for, the content, privacy practices, or terms of any third-party website or service you access via a link on our Platform.
• Links to external sites do not imply endorsement, affiliation, or partnership unless explicitly stated.
• Embedded content from third-party platforms (such as Vimeo video players) is subject to those platforms' own terms of service and privacy policies.
• You access third-party content entirely at your own risk.

9. Disclaimers and Limitation of Liability

9.1 Platform Provided "As Is"

The Platform and all content on it are provided on an "as is" and "as available" basis, without any warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, VJs TV disclaims all warranties, including but not limited to:

• implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• warranties that the Platform will be available, uninterrupted, secure, or error-free;
• warranties as to the accuracy, completeness, timeliness, or reliability of any content on the Platform.

9.2 No Professional Advice

Content on the Platform — including artist profiles, project descriptions, technology information, event listings, and editorial content — is for general informational and cultural purposes only. It does not constitute legal, financial, technical, or professional advice of any kind. You should seek independent professional advice before making decisions based on information found on the Platform.

9.3 Limitation of Liability

To the maximum extent permitted by law, VJs TV, its directors, employees, affiliates, and agents shall not be liable to you for:

• any indirect, incidental, special, consequential, or punitive damages;
• loss of profits, revenue, data, goodwill, or business opportunity;
• any loss or damage arising from your reliance on content published on the Platform;
• any loss or damage resulting from unauthorised access to or alteration of your data or submissions;
• any loss or damage arising from your use of third-party links or embedded content on the Platform.

Where liability cannot be excluded by law, our total liability to you for any claim arising out of or in connection with these Terms or your use of the Platform shall not exceed €100 (one hundred euros) or the equivalent in your local currency.

9.4 Force Majeure

VJs TV shall not be in breach of these Terms or liable for any failure or delay in performance of its obligations due to causes beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, power failures, internet outages, or third-party service failures.

10. Indemnification

You agree to indemnify, defend, and hold harmless VJs TV, its directors, employees, affiliates, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or in connection with:

• your use of or access to the Platform;
• any content you submit to the Platform;
• your breach of these Terms or any applicable law;
• your violation of any third party's rights, including intellectual property or privacy rights;
• any claim by a third party arising from your use of the Platform.

We reserve the right to assume exclusive control of the defence of any matter for which you are required to indemnify us, in which case you agree to cooperate with us in asserting any available defences.

11. Termination and Suspension

We reserve the right, at our sole discretion and without prior notice, to:

• remove any content submitted to the Platform that violates these Terms or applicable law;
• restrict, suspend, or block your access to the Platform if we believe you have violated these Terms;
• discontinue or modify any part of the Platform or its services at any time.

If your access is suspended or content is removed for a violation of these Terms, you may not attempt to circumvent such action by accessing the Platform through alternative means or re-submitting removed content.

Upon termination of your access for any reason, all licences granted to you under these Terms terminate immediately. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and indemnification — shall continue to apply.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. This does not affect any mandatory consumer protection rights you may have under the law of your country of residence.

12.2 Informal Resolution

Before initiating any formal legal proceedings, you agree to first contact us at legal@vjstv.com and give us a reasonable opportunity (30 days) to resolve your complaint informally. Most concerns can be resolved quickly and directly.

12.3 Jurisdiction

If a dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts of Amsterdam, Netherlands. If you are a consumer resident in the EU, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable supplemental terms (such as those governing specific commercial partnerships), constitute the entire agreement between you and VJs TV with respect to your use of the Platform, and supersede any prior agreements or understandings.

13.2 Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from the Terms. The remaining provisions shall continue in full force and effect.

13.3 No Waiver

Our failure or delay in exercising any right or remedy under these Terms shall not constitute a waiver of that or any other right or remedy. A waiver of any breach shall not constitute a waiver of any subsequent breach.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms — including in connection with a merger, acquisition, or sale of assets — without restriction, subject to notifying you where required by law.

13.5 No Partnership or Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and VJs TV. You have no authority to make representations or incur obligations on behalf of VJs TV.

13.6 Language

These Terms are written and shall be interpreted in English. In the event of a conflict between an English version and a translation of these Terms, the English version shall prevail.

14. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services, applicable law, or operational practices. When we make changes:

• we will update the "Last updated" date at the top of this page;
• for material changes, we will notify newsletter subscribers and post a notice on the Platform;
• your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.

If you do not agree with a revised version of the Terms, you should stop using the Platform and, if applicable, request removal of your submitted content.
